With offices in San Diego and Chicago, Mr. Gillaspey engages in the areas of business related transactional matters and litigation. Transactional matters include business formation (corporations, partnerships, limited liability companies, contracts, licensing), and business information protection, inclusive of issues such as trade secret, confidentiality and related matters.
Attorney Gillaspey has represented clients in various areas of business practice, including matters with the Harley Davidson Motor Company, the Ford Motor Company, Bell, and BASF and serves or has served as outside counsel to several companies, including F.A. Technologies of Nevada, Publishers Development Corporation of Illinois, Sionix Corporation of Utah, Pharmatech Corporation of California, BIS of Florida and Calliope Multimedia of California.
In the field of litigation, Mr. Gillaspey works throughout the country, and has represented business clients in such diverse areas as California, New York, Illinois, Maryland, South Carolina, Alabama, Delaware, Arizona, Colorado, Wisconsin, Michigan, Texas, Oregon, North Carolina and Florida.
Mr. Gillaspey is admitted to practice before the United States Supreme Court, the Federal Circuit, the Ninth Circuit, the Fifth Circuit, the U.S. District Courts for Northern, Central and Southern Districts of California, and the U.S. District Court for the Northern District of Illinois. Mr. Gillaspey is a member of several professional organizations, including the American Inns of Court and the American College of Legal Medicine, where he has lectured on areas such as equitable remedies as a litigation tactic.
Representative cases include:
Chirco Trust vs. Boltz, et al. – business assets and commercial property agreements involving business tort claims inclusive of fraud. Judgment for plaintiff $ 1,500,000.00 value. Defendants appealed, judgment confirmed.
NSB Technologies, Inc., vs. Specialty Direct Marketing – California plaintiff versus a Maryland defendant in a partnership/licensing dispute. Judgment for NSB, inclusive of regaining trade secret information and injunction against defendant. Confidential money award.
Sullivan, et al. vs. Sionix Corporation, et al. – Shareholder suit against corporation and individual officers and directors seeking significant damages. Case dismissed against corporation and all individual defendants pre-trial.
Storz Performance, Inc. vs. TransWorld, et al. – trademark litigation involving Italian based companies and U. S. distributor defendants. Judgment for Plaintiff Storz Performance entered for over $ 1,000,000.00 plus entry of permanent injunctions.
Chronowski vs. Topolnicki – Estate litigation with plaintiff claiming large potion of an estate based on fraud and related claims. Case against defendant dismissed pre-trial through granting of Motion for Summary Judgment. Plaintiff appealed, judgment confirmed.
Teskey vs. Love, et al. – Canadian based plaintiff asserting breach of contract action against California defendant claiming damages in excess of $ 1,400,000.00. Settled pre-trial with defendant paying no money.
AWR vs. BCA, et al. – Defense in business litigation (corporate/partnership) involving fraud and misappropriation claims with asserted damages in excess of $ 1,000,000. Defense verdict as to complaint ($ 0 to AWR) and Judgment in favor of BCA on cross complaint. Case appealed by AWR, Appellate Court denied appeal and confirmed trial judgments in favor of BCA.
Attorney Gillaspey has also been an adjunct professor of law at Thomas Jefferson College of Law in the area of practical application/law and motion practice. Mr. Gillaspey is the son of Bruce N. Gillaspey [LTC USA dec] a former cavalry officer, Judge Advocate and law professor. Mr. Gillaspey’s wife of over thirty-five years is Kathie, the two met while Kathie was working for Congressman Philip Crane. They now reside in La Jolla, California
